Garden Pro Planner (“the app”) is built and operated by Kalden Ficklin (“we”, “us”). By downloading or using the app you agree to these terms. If you do not agree, please do not use the app.
Your account
Some features require an account. You are responsible for keeping your sign-in details secure and for activity that happens under your account. You may delete your account at any time — see Delete your account.
Content you add
You keep ownership of everything you add to the app, including photos of your gardens and plants, garden names, notes, and harvest records. We do not claim ownership of your content.
Photos and the licence you grant us
When you upload a photo to the app, you grant Garden Pro Planner a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, sub-licensable and transferable licence to host, store, reproduce, adapt, crop, publish, publicly display and distribute that photo:
- to operate the app and show the photo back to you; and
- to promote Garden Pro Planner — including in App Store and Google Play listings and screenshots, on thegardenplanner.app, in blog posts, in email, on social media, and in paid advertising.
This licence lets us use your photos in promotional material without asking you for permission each time and without any payment to you. We may crop, resize, colour-correct, or place text over a photo so it fits the format it appears in.
We will not publish your name, email address, or precise location alongside a photo unless you have separately agreed to it.
What you promise about the photos you upload
By uploading a photo you confirm that you took it or otherwise have the right to grant the licence above, and that the photo does not infringe anyone else’s rights. Please do not upload photos of other people — including children — unless you have their permission (or, for a child, the permission of their parent or guardian) for the photo to be used as described here. Do not upload anything unlawful, offensive, or that you would not want to see published.
We may remove any content from the app at our discretion.
Withdrawing a photo
You can delete a photo in the app at any time, which removes it from your account and from anywhere we would use it in future. If we have already published a photo in promotional material, deleting it in the app will not automatically pull it from material already printed, distributed, or cached elsewhere, but you can email support@thegardenplanner.app and we will stop using it going forward and remove it from material we control.
Purchases and subscriptions
Optional paid features are sold through the App Store or Google Play, and their billing, renewal, and refund rules apply. Cancel or manage a subscription in your Apple or Google account settings.
Acceptable use
Please do not misuse the app: no attempting to break, overload, or reverse-engineer it, no scraping the plant catalogue for redistribution, and no using it to break the law.
Gardening information
Planting dates, frost dates, pest notes, pet-safety flags, and yield estimates are general guidance and can be wrong for your specific site, season, or variety. They are not professional horticultural, medical, or veterinary advice. Check with your vet before relying on pet-safety information, and with a local extension service or nursery for advice specific to your area.
No warranty, and limits on our liability
The app is provided “as is”, without warranties of any kind. To the fullest extent permitted by law, we are not liable for indirect or consequential losses, lost data, or lost harvests arising from your use of the app. Nothing here limits liability that cannot be limited by law.
Changes to these terms
We may update these terms from time to time. Changes will be posted on this page with a new “last updated” date, and continuing to use the app after that means you accept them.
